佛山顺德酝酿土地限价 济南:开发商不得向购房

10月8日,广东佛山市顺德区国土城建和水利局发布关于征询《顺德区人民政府关于进一步加强国有商住性质征地留用地供应管理的通知》公众意见的通告,拟对顺德的商住留用地地价进行限定,未来五年内,单宗商住地成交价不得超过37.25亿元。
 
On October 8, the Land and Urban Construction and Water Conservancy Bureau of Shunde District, Foshan City, Guangdong Province, issued a circular to solicit public opinions on "Notice of the People's Government of Shunde District on Further Strengthening the Supply Management of Land Requisition and Retention with State-owned Commercial and Residential Nature". The circular intends to limit the land price of commercial and residential land in Shunde. In the next five years, the transaction price of individual commercial and residential land will be limited. No more than 3 billion 725 million yuan.
 
 
 
所谓商住留用地,即集体经济组织国有性质的商住用途征地留用地,是指含有住宅用途的征地留用地。

此次,顺德发布的《征求意见稿》中主要包括四点内容:一是商住留用地供应全区统筹。经批准纳入区建设用地年度供应计划的商住留用地方可推出市场;二是拟转让商住留用地须采用“限地价、竞自持租赁住房”的模式推出市场;三是拟土地成交总价不超过本镇(街道)商住用地历史最高成交总价(即37.25亿元);四是若因底价设定过高导致流拍的,自流拍之日起一年内不予推出市场。

其中明确,根据合理控制单宗土地供应规模、促进土地高效开发利用的原则,需合理控制拟转让留用地土地面积和建设规模,并确保土地成交总价不超过本镇(街道)商住用地历史最高成交总价。

顺德区是佛山市五个行政辖区之一,位于广东省的南部。顺德区辖4个街道(大良、容桂、伦教、勒流)、6个镇(陈村、均安、杏坛、龙江、乐从、北滘)。

按照《征求意见稿》,目前顺德土地成交价最高为乐从镇,单宗商住地成交价最高为37.25亿元,北滘镇次之,为34.3亿元,大良街道地块最高价格20.33亿元;其他镇街的地块最高限价均在20亿元以下。

据《南方日报》此前报道,为了进一步激活顺德农村集体用地交易,顺德区希望结合农村集体产权制度改革,在符合规划和用途管制的前提下,完善集体建设用地使用权流转收益和税费管理,实现农村集体建设用地与国有建设用地同地同价、同权、同责,更好维护村民合法利益。

由此,2015年5月公布的《关于进一步规范建设用地使用权公开交易管理的意见》(顺府发〔2015〕15号)中明确,征地留用地公开交易前,集体经济组织须委托中介评估机构对地价进行评估。处置留用地的收益归集体经济组织及其成员所有,须按照集体资产管理规定进行分配使用。

此次发布的《征求意见稿》自10月8日开始征询意见,并于10月22日结束。按照《征求意见稿》,通知自印发之日起30日后施行,有效期为5年。这也意味着,一旦《征求意见稿》内容获得通过,未来五年内,顺德商住留用地地价将不得超过37.25亿元。

《征求意见稿》同时规定,为保持土地市场平稳发展,避免盲目、过高设定商住留用地起始价、底价导致土地流拍,若因底价设定过高导致流拍的,自流拍之日起一年内不予推出市场。

据记者7日获悉,济南市拟对《济南市城市建设综合配套费征收管理办法》(济政发﹝2003﹞3号)进行修改,目前正在公开征求社会意见。征求意见稿明确开发商不得以任何名义向购房者收取城市基础设施配套费。

征求意见稿中提出,在济南市范围内国有土地上以及市政府批准的集体土地上新建、改建、扩建各类房屋建设项目的单位和个人,均应依据本办法缴纳城市基础设施配套费。

城市基础设施配套费按照房屋建设项目总建筑面积计收,征收标准为246元/平方米,其中:城建综合配套费122元/平方米;专项配套费124元/平方米(包含供水26元/平方米,供气20元/平方米,供热78元/平方米)。
 
Urban infrastructure supporting fees are charged according to the total building area of housing construction projects. The standard is 246 yuan per square metre. 建设单位或个人应在领取建筑工程施工许可证前缴纳城市基础设施配套费,凡未按规定缴纳配套费的建设项目,市城乡建设主管部门不予办理竣工验收备案手续。
 
The construction unit or individual shall pay the supporting fee of urban infrastructure before receiving the construction permit of the construction project. The competent department of urban and rural construction shall not go through the formalities of completion, acceptance and filing for the construction projects that fail to pay the supporting fee in accordance with the regulations.
 
 
 
对已建成需分项配套供水、供气、供热等设施的建设项目,需在行业管理部门组织相关供水、供气、供热等专营单位评估并出具意见后,据本办法单项标准缴纳专项配套费。
 
For the completed projects requiring water supply, gas supply and heat supply, special matching fees shall be paid in accordance with the individual standards of these Measures after the relevant water supply, gas supply and heat supply monopoly units are organized by the industry management departments to evaluate and give their opinions.
