一、法院能不能强制一次性支付抚养费

般来说,离婚时双方会对子女抚养与财产分割问题进行协调,通过签署离婚协议或者提起诉讼。直接抚养子女的一方是抚养费的接收方,而不直接抚养子女的一方则需要支付抚养费。根据《中华人民共和国婚姻法》的第21条和第37条规定,不抚养子女的一方必须支付抚养费,抚养费的数额和支付方式可以按抚养费支付方的实际情况决定,如果拒不支付抚养费,可以提起诉讼向法院申请强制执行。
 
Generally speaking, when divorce occurs, both parties will coordinate the issues of child support and property division by signing a divorce agreement or filing a lawsuit. The direct child-rearing party is the recipient of the maintenance fee, while the non-direct child-rearing party is required to pay the maintenance fee. According to Articles 21 and 37 of the Marriage Law of the People's Republic of China, one party who does not raise a child must pay maintenance fee. The amount and mode of payment of maintenance fee can be decided according to the actual situation of the party who pays maintenance fee. If the party refuses to pay maintenance fee, it may file a lawsuit to the court for enforcement.
 
 
 
抚养费的支付方式有两种:按月支付和一次性支付,抚养费的支付数额一般以能支持子女日常生活需求为准,对于有固定收入的支付方,抚养费数额最高不得超过抚养费支付方月收入的一半,以月收入的百分之二十到百分之三十为最佳。对于没有固定收入的支付方,则会根据行业的平均收入或者年收入衡量。
 
There are two ways of payment of maintenance fee: monthly payment and one-time payment. The amount of payment of maintenance fee is generally based on the need to support children's daily life. For the payer with fixed income, the maximum amount of maintenance fee should not exceed half of the monthly income of the payer of maintenance fee, and the best one is 20-30% of the monthly income. 离婚抚养费当然可以一次性付清,法律上认为有条件且双方都愿意的,可以采取一次性付清抚养费的做法,但是一般不建议采取这种做法。一次性支付一般针对的是由于收入和居所不稳定可能导致长期拖欠抚养费的情况。比较特殊的是,对于支付方是港澳台或者外国籍贯时,多采用一次性付清所有抚养费的方式。事实上对于抚养方来说,一次性拿到所有抚养费并非是理想的,虽然免除了每个月要钱的麻烦,然而考虑到支付方收入周期、生活周期和货币可能会贬值等多种因素,一次性支付并不利于更好的保障子女的日常生活。

第三十七条 离婚后,一方抚养的子女,另一方应负担必要的生活费和教育费的一部或全部,负担费用的多少和期限的长短,由双方协议;协议不成时,由人民法院判决。
 
Article 37 After divorce, one party's children shall bear part or all of the necessary living and education expenses. The amount and duration of the expenses shall be agreed between the two parties. If the agreement fails, the people's court shall decide.
 
 
 
关于子女生活费和教育费的协议或判决,不妨碍子女在必要时向父母任何一方提出超过协议或判决原定数额的合理要求。

子女抚育费的数额,可根据子女的实际需要、父母双方的负担能力和当地的实际生活水平确定。

有固定收入的,抚育费一般可按其月总收入的百分之二十至三十的比例给付。负担两个以上子女抚育费的,比例可适当提高,但一般不得超过月总收入的百分之五十。无固定收入的,抚育费的数额可依据当年总收入或同行业平均收入,参照上述比例确定。 有特殊情况的,可适当提高或降低上述比例。

三、抚养费的变更情况规定

抚养费的变更包括增加、减少和免除三种情况。抚养费增加是子女在必要时提出的,除了因物价调整,原定数额难以维持子女生活所需;或子女升学、实际所需抚养费用超过原定数额以外;还可能因为子女身患疾病,抚养一方无力支付全部医疗费用;或有给付义务的一方经济收入显著增加,在这种情况下,子女与其生活水平相差悬殊等。反之,有给付义务的父方或母方,在特殊情况下也可减免给付抚养费。 减少给付情况,主要指给付一方,由于长期疾病或者丧失劳动能力,经济相当困难,无力按原数额给付,而抚养子女一方又能负担子女的大部分抚养费,那么可请求减少给付。
