一、怎样才可以申请一次性支付抚养费
 
1. How can I apply for one-time payment of maintenance fee?
 
抚养费的给付方式一般是按月支付,比如在每月几号前在探望孩子时支付,或打入孩子抚养费的专用账户。实践中,很多当事人都要求对方一次性支付抚养费,因为这样一来省去要钱的麻烦,二来可以折抵给付对方房屋折价款。

In practice, many parties require the other party to pay a one-time maintenance fee, because this saves the trouble of asking for money, and second, it can be discounted to pay the other party's house discount.
 
 
 
是否采用一次性的支付方式,法院要看对方的实际支付能力以及对方当事人的态度。一般来讲,如果对方当事人不接受一次性支付的,法院判令其一次性支付的可能性是不大的。但这不是绝对的,要求一次性支付也是有相应法律依据的,《人民法院审理离婚案件处理子女抚养问题的若干具体意见》规定“抚育费应定期给付,有条件的可一次性给付”。

二、要求增加抚养费三项理由
 
Three Reasons for Requiring Increased Maintenance Fees
 
基于父母对子女的法定抚养义务,以及抚养费的数额以有利于子女的健康成长为原则,在原定的离婚协议或离婚判决确定的数额已明显不够时,子女当然有权要求父母增加抚养费。为此,《婚姻法》第37条第2款规定,子女在必要时可以向父母中的任何一方请求超过协议或判决原定数额的合理要求。

孩子生活、学习等方面的支出,应由父母双方共同承担。如若其中一方有能力一次性支付全部抚养费用,可一次性支付,若有困难进行一次性支付,另一方也不应过分要求此事。具体支付条件,应由父母双方协商决定,若最终协商无果,可向法院提出起诉,由法院做出最终仲裁。

① 有固定收入的,抚育费数目一般可按其月总收入的20%-30%。负担两个以上子女抚育的,比例可适当提高,但一般不得超过月收入的50%。这里的“月总收入”指工资总额,包括工资、奖金等。可申请法院调查令来调查。② 无固定收入的,抚育费的数目可依当年的收入或同行业的年平均收入,参照①确定。一般参照《道路交通事故赔偿项目参照标准》来确定的年平均人收入、年平均生活费来作为依据。
